Heart Machine Gutted | Build a Rocket Boy Nears Closure | Nex Raises $150M

Heart Machine loses nearly its entire team and Build a Rocket Boy reportedly winds down, while Nex raises over $150 million. The EU KIDS Act reaches online games, and Tokyo Game Show opens its longest edition yet.

Today's Summary

Heart Machine founder Alx Preston says a publisher pulled funding from the studio's next game, forcing layoffs of "nearly everyone" and leaving the future of the Hyper Light developer uncertain. Build a Rocket Boy has not confirmed a closure, but staff farewell posts and reporting that it is permanently shutting make MindsEye's troubled aftermath today's second major studio warning. Capital is still moving: Nex raised more than $150 million in equity and debt after selling over one million Nex Playground units, while former Fortnite Festival developers launched The Drop Circuit and shipped its first UEFN game. Regulation is moving too. The proposed EU KIDS Act explicitly covers online games, requiring safer defaults, age checks, limits on engagement tricks, and stronger protections for minors if adopted. Denuvo filed a US lawsuit against the anonymous cracker voices38 over alleged circumvention in at least 26 games. Sega committed to a second year of free Sonic Racing: CrossWorlds characters, beginning with Bayonetta. Tokyo Game Show opened a record five-day edition, with the PC Gaming Show Tokyo Direct promising more than 35 games and ten world premieres this weekend. GDC added four advisers as it tries to rebuild attendance, Take-Two says even GTA VI still needs aggressive marketing, and Resident Evil creator Shinji Mikami will enter the AIAS Hall of Fame.

Editor's Viewpoint

The sharpest contrast today is not between success and failure. It is between projects that must keep asking permission to exist and products that can prove a repeatable route to customers. Heart Machine lost its next game when one publisher changed its mind. Build a Rocket Boy appears to have run out of road after MindsEye failed to stabilize. Both stories show how quickly a studio disappears when its production plan depends on one oversized bet and one outside decision.

Nex occupies the other side of the market. Its pitch is easy to measure: a small camera-based box, family movement, licensed games, retail distribution, and a subscription. More than one million units sold gives investors a visible path from capital to expansion. The Drop Circuit is smaller, but it follows the same logic. Five experienced developers are building inside Fortnite, where the audience, tools, payments, and discovery system already exist. They traded some control for a shorter route to market.

That does not mean every studio should become a hardware company or a UGC vendor. It means financing is rewarding distribution certainty more aggressively than creative pedigree. The EU KIDS Act adds another pressure: platforms that own the audience will also carry more responsibility for age checks, spending traps, contact systems, and addictive design. The safest place to build may be inside a platform, but the platform's rules are becoming product architecture. Independent studios need more than a good game. They need several ways to reach players, several ways to finance the next milestone, and a plan that survives one partner saying no.

Heart Machine lays off "nearly everyone" after a publisher walks away

Source: PC GamerDate: September 16, 2026Impact: Critical

Heart Machine has laid off nearly its entire team after an unnamed publisher stopped funding the studio's next unannounced game. Founder Alx Preston said the decision arrived this week and left the company without the income, immediate prospects, or other funds needed to keep the staff. He promised placement support for affected developers but said he was not yet sure what comes next or whether Heart Machine can survive.

The studio's position had already narrowed. Hyper Light Drifter established Heart Machine in 2016, but Solar Ash did not reach the same level of attention. Hyper Light Breaker ended development while still in Early Access amid earlier layoffs, and Possessor(s) earned positive Steam reviews without finding a large audience. This cut shows the fragility of milestone-funded development: years of studio identity and shipped work can collapse when one future contract disappears.

Key Points

  • Publisher withdrew โ€” Funding for an unannounced project ended this week.
  • Nearly everyone affected โ€” Preston described the layoffs as devastating.
  • Future uncertain โ€” The founder cannot yet say whether Heart Machine survives.
  • Placement support promised โ€” The studio is coordinating help for departing staff.

MindsEye developer Build a Rocket Boy is reportedly winding down

Source: MeriStationDate: September 17, 2026Impact: Critical

Build a Rocket Boy appears to be winding down after employees across recruitment, art, and level design posted that they were facing redundancy. One HR staff member said he would remain through "the very end" to help wrap things up. Kotaku sources told the publication the studio is permanently closing, though Build a Rocket Boy has not publicly confirmed either the latest layoffs or a shutdown.

The reported end follows a difficult year after MindsEye launched in June 2025. Nearly 100 workers later signed an open letter alleging serious mismanagement, multiple rounds of cuts followed, and management blamed the launch problems on "corporate sabotage." IO Interactive's publishing division stepped away earlier this year, while the IWGB Game Workers union pursued action over alleged workplace surveillance. The studio once grew from 200 to 550 people; the farewell posts now suggest very few paths remain.

Key Points

  • Closure unconfirmed โ€” The company has not made a formal announcement.
  • Farewell posts spread โ€” Multiple disciplines say they are being made redundant.
  • "Very end" language โ€” HR staff are helping wrap up operations.
  • MindsEye fallout โ€” Layoffs, legal claims, and publisher departure preceded the report.

Nex raises over $150 million to take its active-play console global

Source: GamesBeatDate: September 17, 2026Impact: High

Nex has raised more than $150 million in new equity and debt financing to expand Nex Playground beyond its established US base. The controller-free, camera-based system has sold over one million units worldwide and offers more than 60 games, including licensed Bluey, Sonic, and Pac-Man titles, through a subscription. Nex says it is approaching one million subscribers and expects to cross that line before year-end.

The round includes a Series E led by Baillie Gifford and BAI Capital, participation from NBA Investments and Logitech, and a JPMorgan credit facility. Nex plans broader retail and online distribution, international growth in Europe and Asia, and more content partnerships. Former Niantic, Zynga, and EA executive Jeff Shouger becomes chief financial officer, while Shouger and veteran investor Bing Gordon join the board. It is a large bet on a deliberately narrow promise: make family screen time physically active and simple enough to start in the living room.

Key Points

  • $150M+ raised โ€” A mix of equity and debt financing.
  • 1M+ units sold โ€” Nex Playground has moved beyond an experimental hardware niche.
  • Nearly 1M subscribers โ€” The company expects to pass the mark this year.
  • Europe and Asia next โ€” Funding will support global retail and content expansion.

The proposed EU KIDS Act reaches online games, spending traps, and age checks

Source: European CommissionDate: September 17, 2026Impact: Critical

The European Commission has proposed the EU KIDS Act, a child-safety framework that explicitly covers online games alongside social media, video platforms, AI companions, and app stores. If adopted, services used by minors would need safer defaults, private profiles, easy blocking tools, restrictions on unsolicited contact, and limits on features designed to drive excessive use. The proposal also targets reward tricks and spending traps.

Age assurance is central to the plan. App stores and online services would need privacy-preserving checks, while every game would carry an age recommendation enforced before download through the store. AI chatbots inside games or platforms could not switch on automatically for minors. Very large platforms would have to show regulators that their products are safe rather than waiting for authorities to prove harm. The Parliament and Council must now negotiate the text, so implementation details can still change, but youth design has moved from parental guidance into product compliance.

Key Points

  • Games included โ€” The proposal explicitly names online games and app stores.
  • Safety by default โ€” Private profiles, muted strangers, and fewer engagement traps.
  • Age verification โ€” Privacy-preserving checks would gate accounts and downloads.
  • Not law yet โ€” Parliament and Council will negotiate the final text.

Denuvo sues anonymous cracker voices38 over alleged DRM bypasses in 26 games

Source: Tom's HardwareDate: September 16, 2026Impact: High

Denuvo has filed a federal lawsuit against the anonymous cracker known as voices38, alleging that the defendant bypassed its Anti-Tamper system in at least 26 PC games. The complaint, filed September 14 in the Northern District of California, seeks monetary damages and an order preventing further circumvention. Named examples include Hogwarts Legacy, Black Myth: Wukong, Resident Evil Requiem, and Doom: The Dark Ages.

Because Denuvo does not own the copyrights to those games, the case relies on the DMCA's anti-circumvention rules rather than a conventional copyright claim. The company identifies the defendant only as an unknown person or entity and points to Reddit, Discord, and Steam accounts it believes are connected. That could lead to subpoenas seeking identifying information from platforms. The allegations have not been tested in court, but the case marks a shift from technical countermeasures toward direct legal pressure on an individual cracker.

Key Points

  • 26 games alleged โ€” Denuvo says its access controls were bypassed repeatedly.
  • Identity unknown โ€” The complaint names voices38 and additional anonymous defendants.
  • DMCA route โ€” The theory is circumvention of digital locks, not ownership of game copyrights.
  • Early-stage case โ€” No court has ruled on the allegations.

Five former Epic developers launch The Drop Circuit inside Fortnite

Source: GamesBeatDate: September 17, 2026Impact: High

Five veterans of Epic Games and Harmonix have formed The Drop Circuit, a studio focused on music-driven games built with Unreal Editor for Fortnite. The founders came together after Epic's March layoffs hit the Fortnite music team particularly hard. Their combined experience spans design, publishing, legal affairs, creative direction, and the Unreal Engine partner program, giving the startup an unusually complete operating team from day one.

The studio launched its first game, Go Viral Tycoon, on September 17. Players build scenes from randomized prompts, record short character clips, and vote on one another's work across multiple rounds. The Drop Circuit is partnering with Epidemic Sound, gaining access to more than 55,000 tracks for current and future projects. Rhythm games remain part of its long-term plan, but the founders say they first want to build a social community. It is a practical post-layoff strategy: use the platform and tools the team already knows, ship immediately, and avoid financing a standalone distribution stack.

Key Points

  • Five co-founders โ€” Former Epic and Harmonix leaders across creative and business roles.
  • First game shipped โ€” Go Viral Tycoon launched the same day as the studio reveal.
  • Built in UEFN โ€” Fortnite supplies the audience, tools, and commerce layer.
  • 55,000-track catalog โ€” Epidemic Sound provides licensed music access.

Tokyo Game Show opens its longest edition: five days across business and public audiences

Source: Tokyo Game ShowDate: September 17, 2026Impact: High

Tokyo Game Show 2026 has opened at Makuhari Messe with the event's first five-day schedule. September 17 and 18 are business days, followed by three public days through the September 21 holiday. The organizer, Computer Entertainment Supplier's Association, is marking TGS's 30th anniversary with the theme "The Longest Five Days of Nonstop Play."

The expanded format separates dealmaking and press access from a longer consumer weekend while keeping official streams, exhibitor stages, an indie game project, creator programming, cosplay, merchandise, and family activities under one event. Major exhibitors include platform holders and large Japanese publishers alongside regional and independent developers. For an industry that increasingly announces games through isolated digital broadcasts, five physical days in Chiba are also a test of whether major shows can still create a shared market moment rather than a short burst of trailers.

Key Points

  • Five days โ€” The longest Tokyo Game Show in the event's history.
  • Two business days โ€” September 17โ€“18 focus on trade and media.
  • Three public days โ€” The show runs through Monday's holiday.
  • 30th anniversary โ€” TGS began in 1996 and is expanding its format.

GDC adds four advisers as the festival format tries to rebuild momentum

Source: GamesBeatDate: September 17, 2026Impact: Medium

GDC Festival of Gaming has added four members to its advisory board: 1Up Ventures general partner and jobs advocate Amir Satvat, Zebra Partners co-founder Perrin Kaplan, Gearbox narrative writer Alexa Ray Correia, and Dragon Snacks Games fractional chief operating officer Lucien Parsons. The appointments bring investment, marketing, writing, operations, and workforce experience into the group guiding the San Francisco event.

The move follows GDC's shift toward a city-wide festival model as it works to recover its former scale. GamesBeat reports that last year's conference drew about 20,000 attendees, well below the event's historical crowds, though the broader format produced a stronger show. Satvat's presence is especially pointed after years of layoffs: his community efforts have helped more than 5,000 people find work. An advisory board cannot solve the event's cost and identity challenges by itself, but the mix suggests GDC wants employment, independent production, and commercial access to sit alongside technical sessions.

Key Points

  • Four new members โ€” Satvat, Kaplan, Correia, and Parsons join the board.
  • Broader expertise โ€” Jobs, investment, narrative, marketing, and studio operations.
  • 20,000 attendees last year โ€” The event is rebuilding from a smaller base.
  • Festival model โ€” GDC is extending beyond the traditional conference footprint.

Take-Two says even GTA VI still needs to be "marketed aggressively"

Source: GamesBeatDate: September 16, 2026Impact: Medium

Take-Two CEO Strauss Zelnick says Grand Theft Auto VI's global recognition does not remove the need for a large marketing campaign. Speaking at a GamesBeat Insider event, he separated awareness from enthusiasm: players may know the brand, but Take-Two still has to show what they will get, why interaction is worth the time, and why the release deserves attention at launch.

Zelnick compared the situation with the Barbie movie, another universally recognizable property that still required sustained promotion. Games add extra friction because audiences must choose a platform, install the product, learn its systems, and actively participate. Creators with established audiences can amplify a campaign, but Zelnick argued that marketing cannot persuade people a bad game is good. The remarks explain why GTA VI's unusual Netflix preview and broad event strategy matter: blockbuster awareness creates a high ceiling, while the campaign must convert that familiarity into a purchase and ongoing play.

Key Points

  • Awareness is not enthusiasm โ€” Recognition alone does not finish the sale.
  • Games demand effort โ€” Installation, platform choice, and learning raise the barrier.
  • Creators help โ€” Long-standing audiences can extend a campaign's reach.
  • Quality still decides โ€” Marketing cannot make a weak product good.

Resident Evil creator Shinji Mikami will enter the AIAS Hall of Fame

Source: AIASDate: September 16, 2026Impact: Medium

Shinji Mikami will receive the Academy of Interactive Arts & Sciences Hall of Fame Award at the 30th annual DICE Awards on February 18, 2027. The Resident Evil director is being recognized for more than three decades of work across survival horror and action games. Grasshopper Manufacture founder Goichi Suda, who collaborated with Mikami on Killer7 and Shadows of the Damned, will present the award.

AIAS president Meggan Scavio called Mikami an influential figure whose originality continues to shape action-game design. His career includes directing Resident Evil and Resident Evil 4, founding Tango Gameworks, and overseeing projects including The Evil Within before leaving the studio. He now leads Unbound as chief executive and creative director; Stellar Blade developer Shift Up acquired the company earlier this year. The induction arrives during a week dominated by studio instability, making the honor a reminder that durable creative influence often outlives the companies and ownership structures around it.

Key Points

  • February 18, 2027 โ€” Mikami will be inducted at the 30th DICE Awards.
  • Suda51 presents โ€” A collaborator from Killer7 and Shadows of the Damned.
  • 30+ year career โ€” Resident Evil, Tango Gameworks, and modern action design.
  • Now at Unbound โ€” The studio was acquired by Shift Up earlier this year.
